Terms of Use

These terms govern use of Edgeryt Hire, the hiring and assessment workspace from Eroforze Systems Private Limited (Edgeryt), including apply, booking and assessment pages a workspace shares worldwide. We provide software only — not employment, recruiting, or legal advice. By creating an account or using a page we provide, you agree to these terms. Last updated 5 October 2026.

1. Introduction

These Terms of Use (“Terms”) are a binding agreement between you and Eroforze Systems Private Limited (“Eroforze Systems”, “we”, “us”) concerning Edgeryt Hire and Edgeryt Assessment experiences linked from a workspace. Additional product-specific terms (including Candidate Assessment Terms) apply where indicated.

Eroforze Systems Private Limited is a technology provider incorporated in India (CIN U28249TZ2024PTC031297). We do not employ candidates, act as an employment agency, consultant, or staffing firm, or make hiring, rejection, compensation, or promotion decisions for any Customer. Those decisions are made solely by the Customer and its personnel.

Hire vs Assessment. These Terms primarily govern Customers and workspace members using Edgeryt Hire. If you take an assessment on Edgeryt Assessment, the Candidate Assessment Terms apply to that experience; both documents may apply where you use apply or booking pages and then an assessment.

2. Definitions

  • Customer / Employer — the organisation that owns a workspace.
  • Workspace member — a user invited to a Customer workspace with a role.
  • Candidate — a person who applies, books or takes an assessment.
  • Platform — Edgeryt Hire software and related services we operate.
  • Customer Content — jobs, job descriptions, assessments, questions, scoring rules, notes, candidate records, files and other data the Customer or its members add or configure.
  • AI Output — text, scores, suggestions or other results produced by optional AI features (such as question generation or written-answer grading).
  • Integrity Signals — proctoring and anti-cheating indicators (for example focus events, device metadata, identity checks, automation hints and integrity summaries) generated during an assessment.
  • Integration Services — third-party products a Customer connects (such as Google, Microsoft, Zoom when available, payment checkout, email delivery, optional AI or coding sandbox providers).
  • Fees — subscription and usage charges for the Platform billed to a Customer under these Terms.

3. Eligibility

You must be able to form a binding contract under applicable law and use the Platform only for lawful hiring and assessment purposes.

If you register or use a workspace on behalf of an organisation, you represent that you are at least 18 years old, you have authority to bind that organisation, and the organisation accepts these Terms as a commercial B2B agreement (not a consumer transaction). The organisation is the “Customer” responsible for Fees, compliance and indemnity in these Terms.

4. Account Registration

  • Provide accurate name and an email address you control.
  • Keep credentials confidential; you are responsible for activity under your account.
  • Optional Google sign-in and two-factor authentication may be available.

5. Employer / Customer Accounts

Workspaces may include roles such as Admin (owner), Admin, Assessment Manager and Interviewer, with access limited by role. Admins may invite and remove members. The Customer is responsible for all activity in its workspace and for configuring retention, branding and integrations.

6. Candidate Accounts and Invitations

Candidates typically access apply, booking or assessment links without creating a full workspace account. Named invites may require confirming identity details; open invites may require registration of name and email.

Assessment experience. Taking an assessment is governed by the Candidate Assessment Terms (including disclaimers, liability limits and consent to monitoring). Apply and booking pages may also be subject to these Terms where relevant (for example prohibited use). The hiring organisation — not Eroforze Systems Private Limited — decides whether you are selected or rejected.

7. Platform Role; Use of the Hiring Platform

The Platform provides tools for Customers to publish jobs, collect applications, run assessments, schedule interviews and collaborate with workspace members. We host and operate the software, maintain core infrastructure, and process data as described in our Privacy Policy and, for candidate hiring data, as processor under our DPA.

No employment decisions. We do not screen, select, reject, rank for employment, interview on a Customer’s behalf, or communicate hiring outcomes to candidates except through features the Customer configures (such as automated emails or templates the Customer enables). Any offer, rejection, shortlist or other employment action is the Customer’s alone.

The Customer decides whom to invite, what job postings and assessments to publish, how to configure proctoring and AI features, which Integration Services to connect, and how to use scores and Integrity Signals. Customer Content belongs to the Customer. We may remove or restrict content that violates these Terms or creates legal or security risk, but we are not obliged to monitor Customer Content.

8. Use of the Assessment Platform

Assessments may be published from Hire and taken on the assessment origin. Scoring may combine auto-marking, coding sandbox results, AI grading (when enabled) and human review. Results and Integrity Signals are delivered to the Customer per its settings. We do not validate that an assessment measures job-related skills for a particular role; the Customer designs or selects content and interprets results.

9. Assessment Rules and Candidate Responsibilities

Candidates must follow the rules disclosed before starting, including monitoring and identity checks when enabled. The Customer configures proctoring level and content. See Candidate Assessment Terms.

10. Prohibited Uses

You must not:

  • Violate law, or use the Platform to harass, discriminate unlawfully or mislead.
  • Access another workspace or account without authorisation.
  • Interfere with security, scrape at scale, or reverse engineer the Platform except as allowed by law.
  • Upload malware or content you lack rights to share.
  • Use the Platform to build a competing product by copying our materials or confidential features.
  • Circumvent assessment integrity controls or assist others in doing so.

11. Customer Responsibilities and Legal Compliance

As the organisation using the Platform for hiring, the Customer — not Eroforze Systems Private Limited — is responsible for its recruitment programme and for compliance with laws that apply to the Customer in each jurisdiction where it recruits, hires or assesses people, including India, the United States, the United Kingdom, the European Union and European Economic Area, Australia, and other countries where customers and candidates use the service.

Without limiting the above, each Customer is solely responsible for:

  • Hiring and employment decisions — including who to invite, interview, assess, select, reject, or extend offers; compensation; and any adverse action. The Customer must not represent that Eroforze Systems Private Limited made or endorsed those decisions.
  • Job postings and Customer Content — accuracy, legality and non-discrimination of job descriptions, requirements, assessments, questions, scoring thresholds and communications sent through or stored on the Platform.
  • Candidate data — ensuring a lawful basis and required notices before collecting, importing or processing candidate personal data; honouring candidate rights as controller; configuring retention, export and erasure; and the accuracy of data the Customer or its members supply (including imports and manual entries).
  • Assessments and proctoring — choosing appropriate assessment content and proctoring levels; providing required disclosures and obtaining valid consent where monitoring, biometrics or recordings apply; and deciding how Integrity Signals may be used (including human review before any adverse action).
  • AI features — enabling AI only where permitted; reviewing AI Output before relying on it; not using AI Output as the sole basis for rejection or other adverse employment decisions; and complying with applicable automated-decision and transparency rules.
  • Integrations — authorising Integration Services, complying with third-party terms, and managing tokens, calendars and meeting links the Customer connects.
  • Workspace access — inviting only authorised members, assigning appropriate roles, and all activity under the Customer’s workspace accounts.
  • Regulatory compliance — employment, labour, equal opportunity, anti-discrimination, recruitment, privacy, data protection, biometric, surveillance, consumer and sector-specific rules (as applicable to the Customer’s use).

We do not provide legal, HR or compliance advice. The Customer should obtain its own counsel where needed.

12. Candidate Responsibilities

Provide accurate information, complete assessments yourself without unauthorised help, and grant only the browser permissions required for the assessment you chose to take. Do not share invite links that are personal to you.

13. AI Features and Automated Processing

Optional AI features (such as question generation, written-answer grading and related tooling) may be limited by plan and deployment configuration. AI Output is generated probabilistically and may be incomplete, biased, outdated or wrong. AI Output is not a professional opinion, background check, or guarantee of candidate skill, honesty or suitability.

The Customer must treat AI Output as decision-support only, subject to meaningful human review by qualified personnel before any rejection, disqualification or other adverse action. The Customer is responsible for configuring whether AI features are used, validating results, and complying with laws governing automated processing in hiring. See our AI Notice.

Eroforze Systems Private Limited does not guarantee the accuracy, fairness or legality of AI Output and is not liable for hiring outcomes based on AI Output except as liability cannot be excluded under mandatory applicable law.

14. Proctoring and Anti-Cheating Features

Customers may enable integrity and proctoring features (such as fullscreen or focus tracking, clipboard controls, camera, microphone, screen share or record, identity verification and automation detection). Candidates see a disclosure and must consent before starting. On-device checks and uploaded evidence are described in the Privacy Policy and Assessment Terms.

Integrity Signals are indicators only. They may produce false positives or false negatives; they do not prove cheating or prove integrity. Browser-based monitoring cannot detect every form of misconduct. The Customer must not treat Integrity Signals as the sole basis for rejection or other adverse action without appropriate human review and consideration of context.

The Customer is responsible for choosing proctoring settings appropriate to the role and jurisdiction, providing legally required notices and consents, and responding to candidate questions about monitoring.

15. Content and User-Generated Data

Customers retain ownership of Customer Content. Candidates retain rights in materials they submit, subject to the licence needed for the Customer and us to process applications and assessments.

Each user warrants that content they submit is accurate to the best of their knowledge, does not infringe third party rights, and may lawfully be uploaded and processed on the Platform. Customers are solely responsible for Customer Content and for consequences of publishing job postings, assessments or messages, including claims from candidates or regulators.

16. Intellectual Property

The Platform, branding, question libraries we supply, software and documentation are owned by Eroforze Systems Private Limited or its licensors. These Terms do not transfer ownership of our IP to you.

17. License to Use the Platform

We grant Customers a limited, non-exclusive, non-transferable right to use the Platform during an active subscription or free plan, solely for their internal hiring and assessment purposes, subject to these Terms and plan limits.

18. Third-Party Services and Integrations

Integration Services (including meeting providers, payment checkout, email delivery, optional AI, coding sandbox, and infrastructure subprocessors listed on our Subprocessor List) are operated by third parties. When a Customer enables an integration, the Customer authorises us to exchange data with that provider as needed to operate the connection. Third-party terms and privacy policies apply to the Customer’s use of those services.

Eroforze Systems Private Limited does not control Integration Services and is not responsible for their availability, security, acts, omissions, content or policies. Outages, API changes, account suspensions or data handling by a third party are between the Customer and that provider, subject to our obligation to process personal data under the DPA where we act as processor. Zoom Connect may be unavailable until Marketplace approval is live.

The Customer is responsible for maintaining valid integration accounts, permissions and compliance with third-party acceptable-use rules.

19. Fees, Subscriptions and Payments

Paid plans are billed through our payment provider (currently Razorpay). Charges may appear on your statement under Eroforze Systems Private Limited. Prices, currencies, taxes (including GST where shown) and plan limits are presented in-product. You authorise recurring charges for the selected interval until cancelled according to the billing UI. Failure to pay may result in suspension or reversion to a free plan.

20. Free Trials

We may offer trials of paid features. At the end of a trial, paid features may stop unless you subscribe. Trial terms shown at signup or in billing settings control.

21. Service Availability and Changes

We aim to keep the Platform available but do not guarantee uninterrupted, timely, secure or error-free operation. The Platform may be unavailable due to maintenance, upgrades, infrastructure or Integration Service failures, network issues, force majeure events, or circumstances beyond our reasonable control.

We may modify, suspend or discontinue features (including beta or plan-limited features) with reasonable notice where practicable. We are not liable for downtime, delayed assessments, missed interviews, or lost data except as liability cannot be excluded under mandatory applicable law. Customers should maintain their own backups and exports of critical Customer Content where the product provides export tools.

22. Support and Maintenance

Support is available at privacy@edgeryt.com. We may perform maintenance that temporarily affects availability.

23. Security and Account Protection

You must protect account credentials and promptly notify us of suspected unauthorised access. We implement security measures described in our Trust Center and Privacy Policy, including measures appropriate for a cloud hiring platform.

No system is perfectly secure. We do not guarantee that the Platform or Customer Content will be free from unauthorised access, loss, corruption, viruses or other harmful components. Customers remain responsible for workspace access controls, member offboarding, device security, and how they download or share candidate data outside the Platform.

24. Confidentiality

Each party may receive confidential information of the other. Recipients must use it only to perform under these Terms and protect it with reasonable care. Assessment content and candidate data must be treated as confidential by workspace members except as needed for hiring.

25. Data Protection and Privacy

Our Privacy Policy and, for Customers, our Data Processing Agreement form part of these Terms by reference. For candidate hiring data, the Customer is controller and we are processor, except where we process data as controller for our own account and security purposes.

The Customer is responsible for its privacy programme as controller (notices, lawful bases, candidate rights, cross-border transfers to the extent the Customer directs processing). Eroforze Systems Private Limited processes personal data only as described in those documents and the Customer’s instructions via the Platform.

26. Warranties and Disclaimers

EXCEPT AS EXPRESSLY STATED IN A SEPARATE WRITTEN AGREEMENT SIGNED BY EROFORZE SYSTEMS PRIVATE LIMITED, THE PLATFORM AND ALL AI OUTPUT, INTEGRITY SIGNALS, SCORES, REPORTS AND RELATED MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EROFORZE SYSTEMS PRIVATE LIMITED AND ITS AFFILIATES, LICENSORS AND SUPPLIERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE PLATFORM WILL MEET A CUSTOMER’S REQUIREMENTS OR HIRING OBJECTIVES; (B) JOB POSTINGS, ASSESSMENTS OR CUSTOMER CONTENT ARE LAWFUL, NON-DISCRIMINATORY OR SUITABLE FOR ANY ROLE; (C) CANDIDATES ARE TRUTHFUL, QUALIFIED OR FIT FOR EMPLOYMENT; (D) ASSESSMENT OR INTERVIEW RESULTS ARE ACCURATE, COMPLETE OR PREDICTIVE OF JOB PERFORMANCE; (E) AI OUTPUT OR AUTO-MARKING IS CORRECT, UNBIASED OR APPROPRIATE FOR ADVERSE ACTION; (F) INTEGRITY SIGNALS DETECT ALL MISCONDUCT OR ARE FREE OF FALSE POSITIVES OR NEGATIVES; (G) INTEGRATION SERVICES WILL REMAIN AVAILABLE OR UNCHANGED; OR (H) THE PLATFORM WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

WE DO NOT PROVIDE LEGAL, HR, EMPLOYMENT, RECRUITING OR COMPLIANCE ADVICE. ANY GUIDANCE IN DOCUMENTATION OR SUPPORT IS GENERAL INFORMATION ONLY. HIRING OUTCOMES AND EMPLOYMENT DECISIONS ARE ENTIRELY THE CUSTOMER’S RESPONSIBILITY.

Some jurisdictions do not allow exclusion of certain warranties. In those jurisdictions, disclaimers apply to the fullest extent permitted and statutory rights that cannot be waived remain unaffected.

27. Limitation of Liability

Exclusion of certain damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EROFORZE SYSTEMS PRIVATE LIMITED AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, ANTICIPATED SAVINGS, OPPORTUNITY, OR DATA (WHETHER DIRECT OR INDIRECT), ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This exclusion applies to claims based on hiring or rejection decisions, job postings, assessments, AI Output, Integrity Signals, Customer Content, candidate data supplied by Customers, Integration Services, outages, security incidents, or Customer or candidate use or misuse of the Platform.

Cap on aggregate liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF EROFORZE SYSTEMS PRIVATE LIMITED AND ITS AFFILIATES ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE) WILL NOT EXCEED THE GREATER OF: (I) THE TOTAL FEES PAID OR PAYABLE BY THE CUSTOMER TO US FOR THE PLATFORM IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (II) INR 10,000 (INDIAN RUPEES TEN THOUSAND) OR USD 100 (UNITED STATES DOLLARS ONE HUNDRED), WHICHEVER IS LOWER.

The cap applies per Customer (organisation), not per user account. Multiple claims do not enlarge the cap. If you use the Platform without a Customer relationship (for example only as a candidate under invite links), the cap applies to our liability to you individually and is limited to INR 10,000 (Indian Rupees ten thousand) or USD 100 (United States Dollars one hundred), whichever is lower where no Fees were paid by you, except where mandatory law requires otherwise. Candidate assessment use is also subject to the Candidate Assessment Terms.

Non-excludable liability. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under mandatory applicable law, including (where applicable) liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or wilful misconduct. If a court or regulator finds that a limitation or exclusion in this Section 27 is unenforceable for a particular claim, our liability for that claim will be limited to the maximum extent permitted by law, and the remaining Terms will continue in effect.

Customers acknowledge that Fees reflect the allocation of risk in this Section 27 and that Eroforze Systems Private Limited would not provide the Platform on the same terms without these limitations.

28. Customer Indemnification

To the maximum extent permitted by applicable law, each Customer will defend, indemnify and hold harmless Eroforze Systems Private Limited, its affiliates, and their respective officers, directors, employees and agents (collectively, “Indemnified Parties”) from and against any third-party claims, demands, suits, proceedings, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to:

  • Customer Content, job postings, assessments, or messages sent or configured by the Customer or its members;
  • hiring, selection, rejection, ranking, compensation or other employment decisions by the Customer;
  • the Customer’s recruitment or assessment programme, including alleged discrimination, unfair treatment or unlawful employment practices;
  • the Customer’s failure to provide required notices, consents or privacy rights as data controller of candidate data;
  • candidate or applicant data supplied, imported or entered by the Customer that is inaccurate or processed without a lawful basis;
  • the Customer’s configuration or use of proctoring, recordings, biometrics or Integrity Signals;
  • the Customer’s use or reliance on AI Output without appropriate human review;
  • unlawful, negligent or unauthorised use of the Platform by the Customer or its members;
  • the Customer’s use of Integration Services or breach of third-party terms;
  • violation of applicable employment, labour, equal opportunity, recruitment, privacy or sector-specific laws by the Customer; or
  • breach of these Terms or the DPA by the Customer; or
  • claims by candidates, applicants, employees or regulators against Eroforze Systems Private Limited arising from the Customer’s hiring programme, assessments, proctoring, AI use or Customer Content (including where we are joined as a party because of the Customer’s acts or omissions).

Process. We will prompt the Customer of a claim where we are aware of it and allow the Customer to control the defense and settlement, provided the Customer does not settle any matter in a way that admits fault by an Indemnified Party or imposes non-monetary obligations on us without our prior written consent (not unreasonably withheld). We may participate with our own counsel at our expense. The Customer will cooperate reasonably with the defense.

This Section 28 is in addition to, and not in lieu of, other remedies available to Eroforze Systems Private Limited. If indemnity is unenforceable in a jurisdiction for a particular claim, the Customer remains responsible to the fullest extent permitted by law.

29. Suspension and Termination

We may suspend or terminate access for breach, legal risk, non-payment or to protect the service. Customers may stop using the Platform and cancel paid plans via billing settings or by contacting support. We may delete or anonymise data per the Privacy Policy and Customer retention settings after termination.

30. Effect of Termination

On termination, licences end. Sections that by nature should survive (including IP, confidentiality, disclaimers, liability limits, indemnities and governing law) survive.

31. Changes to the Platform or Terms

We may update these Terms or the Platform. Material Terms changes will be indicated by updating the date on this page. Continued use after the effective date constitutes acceptance where permitted.

32. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, including the laws of the State of Tamil Nadu applicable therein, without regard to conflict-of-law rules. Where a dispute is subject to Indian law, the Indian Contract Act, 1872, the Information Technology Act, 2000 (and rules made thereunder), and the Digital Personal Data Protection Act, 2023 (DPDP Act), in each case where applicable apply to the extent relevant to interpretation and enforceability of these Terms (including limitation and indemnity clauses in commercial contracts).

For disputes with a Customer in its commercial capacity, Eroforze Systems Private Limited may, at its option, require binding arbitration under the Arbitration and Conciliation Act, 1996, with seat at Coimbatore, Tamil Nadu, India, before a sole arbitrator, in English, instead of court proceedings where arbitration is permitted by law. If we do not elect arbitration, or where arbitration is not permitted, Section 33 applies.

33. Jurisdiction

Exclusive jurisdiction for disputes arising from these Terms lies in the courts at Coimbatore, Tamil Nadu, India, except where applicable law requires otherwise or we seek injunctive relief elsewhere.

34. Notices

We may notify you via the Platform, email on your account, or the contact email on your workspace. Legal notices to us: privacy@edgeryt.com.

35. Severability

If any provision of these Terms is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable (or severed if modification is not possible), and the remaining provisions will remain in full force. If a limitation of liability or indemnity is found unenforceable, the parties intend the closest enforceable limit permitted by law to apply.

36. Entire Agreement

These Terms, the Privacy Policy, Cookie Policy, AI Notice, Assessment Terms (for candidates) and any DPA or order form constitute the entire agreement regarding the Platform and supersede prior proposals on the same subject.
